No formal notice without prior contact

Should you wish to assert any claims whatsoever arising from matters relating to copyright, competition law or trade mark law, please contact us immediately. This will help to avoid unnecessary legal disputes, formal notices and costs. Should claims of the aforementioned nature be made, we hereby undertake, prior to any final, legally binding resolution, to take remedial action that will definitively rule out any risk of recurrence.

Any invoice for costs arising from a lawyer’s warning letter issued without prior contact would then be rejected on the grounds of failure to comply with the duty to minimise damage. In the event of warning letters and follow-up measures that are unnecessary or unjustified in this sense, we would respond with an action for a declaratory judgement.
